Foreign Divorce Decree Recognition in Turkish Divorce Law

If you have obtained a divorce decree from a non-Turkish court and are a Turkish citizen, the marriage may not automatically be annulled in Turkey. Therefore, you need to file a suit with the Turkish family court for recognition of the foreign divorce decree to terminate the marriage in Turkey legally.

It is important to note that some divorce decrees issued outside of Turkey may not be considered valid for recognition in Turkey. However, this can be used as supportive evidence if you would like to file a divorce file in Turkey.

The following documents are required for the recognition process:

• A Power of Attorney to a lawyer in Turkey
• The original copy of the definitive divorce decree, this document must be apostilled

Execution of Foreign Divorce Decrees

The execution process refers to approving the foreign court’s sentence to make it enforceable in Turkey.

On the other hand, according to the Civil Registry Services Law, spouses can register a divorce decision by applying to the Turkish Consulates or Civil Registry Offices together or through their attorneys.  However, court decisions containing provisions on alimony, custody, and compensation cannot be considered within this scope.
