Read the notice before choosing a remedy
A refusal means an application was not granted. Cancellation affects an existing permit. Non-renewal concerns a request to extend it. None should automatically be treated as a deportation or detention decision. There may nevertheless be several decisions in the same file, with different deadlines and different remedies.
Keep the decision, its reasons, the envelope or electronic service record, the permit and application documents. Record when and how you or your representative received each document. Review any instruction to leave Türkiye immediately with counsel; the period for bringing a lawsuit is not necessarily permission to remain throughout that period.

The permit category matters
The legal conditions differ between short-term, family, student, long-term, humanitarian and trafficking-victim permits. The review should match the authority’s stated ground to the actual category rather than use a generic list of rejection reasons. Official Migration Management guidance separately describes grounds for refusal, cancellation and non-renewal by category. [S5]
For a decision on an application made within Türkiye, Article 25 of Law No. 6458 requires consideration of matters including family ties, duration of residence, circumstances in the country of origin and the child’s best interests. Notification must explain the effective exercise of challenge rights and related obligations. These considerations do not guarantee a favourable decision. [S2]
Identify what the authority says is missing or wrong
Build a comparison between the reason given and the evidence submitted. For example, a dispute about accommodation should be examined against the actual address records, agreement and submissions. A dispute about a family connection needs the relevant civil-status and custody evidence. A student case should be checked against current enrolment and the institution’s records.
Useful preparation includes:
- Passport, entry/exit history, previous permits and current application number.
- The original application and dated proof of every supplementary submission.
- Requests for missing documents and responses to them.
- Evidence relevant to the actual category, including accommodation, insurance, study or family records.
- Any entry restriction, deportation decision or other separate measure.
- Documents explaining urgent family, education, health or child-welfare consequences.
Do not manufacture a new purpose of stay or submit inconsistent explanations to address the refusal. A new application and a challenge to the earlier decision are different steps.

Bringing an annulment action
The appropriate administrative court and defendant should be identified from the decision. The general sixty-day rule under Article 7 of Law No. 2577 applies unless a special rule governs the particular act. The starting date and any interruption or suspension must be calculated from the service evidence, not an informal estimate. [S3]
An administrative reconsideration request under Article 11 can affect the remaining litigation period when its requirements are met. It does not simply create a fresh sixty-day period. Obtain advice before relying on such a request; an informal enquiry is not necessarily an Article 11 application. [S3]
The case should identify the challenged act, grounds of unlawfulness, supporting records and relief requested. A reasoned disagreement with the authority’s factual assessment is more useful than a general assertion that the decision is unfair. Missing records can be identified for production through the proceedings, without assuming that waiting for them extends time.
Article 31(7), added in November 2024, provides specific procedural rules for court challenges to refusal or cancellation of short-term residence permits. The file is treated as complete when the defence is submitted or its submission period expires; a hearing is at the court’s discretion. Where service cannot be made at the claimant’s stated address, the period referred to in Article 26(3) of Law No. 2577 is two months. These procedural rules should not be confused with the deadline for filing the original action. [S2]
Does a lawsuit let me remain in Türkiye?
No. Filing an ordinary residence-permit lawsuit does not automatically stay the administrative act or establish a right to remain in Türkiye. Interim relief, lawful-stay arrangements and any separate removal decision must be considered independently. A stay request requires the statutory conditions in Article 27; filing the request is not the same as obtaining an order. [S3]
If a deportation decision has also been served, its special short filing period must be addressed separately. Likewise, a detention challenge concerns deprivation of liberty rather than the grant of a residence permit. A permit case should not be used as a substitute for either remedy.

What an outcome means
An annulment judgment concerns the legality of the challenged act. Its practical implementation must be read from the judgment and the applicable procedure. Do not promise that every successful case immediately produces a card of a particular duration. Further steps or a fresh administrative assessment may be required.
If the claim is dismissed, review the judgment’s appeal information and service date promptly. The available route is decision-specific. Do not assume that the special finality rule for deportation judgments also applies to ordinary residence-permit litigation.
Frequently asked questions
Does property ownership guarantee a permit?
No. Ownership alone does not replace the requirements of the relevant permit category.
Can I submit another application instead?
A new application may be possible depending on the purpose, status and applicable rules. It does not automatically preserve the deadline for challenging the refusal.
Does a Turkish spouse guarantee annulment?
No. Family circumstances are relevant, but the statutory conditions, evidence and reasons must still be assessed.
Can a lawyer handle the litigation?
An appropriately authorised lawyer can act in proceedings. Separate administrative attendance, identity or biometric requirements should be checked individually.
What should I send first?
The complete decision and service evidence, followed through an agreed secure channel by the application and relevant records. Avoid sending passport copies or sensitive family information through an unagreed public form.
