Turkish Citizenship Cancellation After Real Estate Investment: Legal Grounds and Judicial Remedies

Can a citizenship cancellation decision be challenged?
A decision cancelling or withdrawing previously acquired Turkish citizenship may be challenged through judicial review. The available remedy, competent court and filing period depend on the decision, its legal basis and how it was notified. A disputed property valuation or cancelled investment conformity certificate does not, by itself, establish that citizenship cancellation is lawful. Each administrative decision must be assessed on its own facts and legal grounds.

Start with the decision you have received
A problem with a property investment does not describe a single legal procedure. A refusal of a pending citizenship application, cancellation of investment conformity, cancellation of citizenship already granted and withdrawal of the original acquisition decision are different acts. The legal grounds, competent authority, notification date and available remedy must be identified for each one.
If you receive a notice, retain every page and its service record. Do not wait for a developer, agent or valuation provider to resolve the commercial dispute before having the administrative deadline checked. A later citizenship decision may depend on an earlier investment decision that requires its own challenge.
Cancellation and withdrawal are legally distinct
Article 31 of Citizenship Law No. 5901 addresses acquisition resulting from the person’s false declaration or concealment of material facts. Article 32 makes that cancellation effective from the cancellation decision and extends it to a spouse or children who acquired citizenship through that person. Article 40 separately addresses decisions subsequently found to have been issued without the legal conditions or issued in duplicate. These provisions should not be treated as interchangeable. [S1]
The acquisition decision, the legal provision invoked and the evidence relied upon must therefore be read together. An allegation in an investigation is not itself a final judicial finding. Conversely, a claim that an intermediary handled the paperwork does not by itself establish that the investment legally qualified.
Conformity is not the citizenship decision
A real-estate file may contain a valuation report, a TTB identifying the amount accepted for citizenship purposes, investment conformity/TYTB documentation and a separate citizenship acquisition decision. A dispute over one document must be traced through the administrative file; those documents do not all have the same issuer or legal effect.
TKGM announced an amendment to Circular 2024/4 on 29 September 2026. Valuation and TTB requirements must be checked against the rules applicable to the particular transaction and any relevant transitional provisions. This guide does not set out an internal administrative procedure for cancelling conformity certificates. The written cancellation decision, its stated legal basis and the supporting file must be examined separately from any citizenship decision. [S7]

Valuation and payment disputes: what needs examination?
Prepare a chronology separating the purchase, payment, currency conversion, valuation, conformity, citizenship acquisition and later review. In an alleged overvaluation dispute, compare the original valuation date and methodology with the later assessment. A disagreement between two valuations is not, without further analysis, proof of a false declaration by the investor.
The evidence review should identify:
- The property and independent unit actually assessed, and any discrepancy in area, legal status or physical condition.
- The amount recorded in the deed or notarised promise, the amount actually paid and the bank records supporting it.
- The DAB and underlying bank transaction, rather than relying solely on a scanned certificate supplied by an intermediary.
- The valuation report, TTB where applicable, conformity document and the precise reasons for any cancellation.
- Ownership and seller history, registered restrictions, relevant undertakings and any later transfer or enforcement sale.
- Statements made or signed by the investor and the scope of any power of attorney.
This is an evidence checklist, not a finding that every discrepancy permits cancellation. It also does not promise that a supplementary report or additional payment can cure an original qualification problem. The rules applicable on the relevant dates and any valid transitional provisions must be established first.
What a verified investment case illustrates
In its decision of 5 February 2026, E.2024/405, K.2026/361, the Council of State’s Tenth Chamber considered withdrawal under Article 40 following a finding that DAB documents were untrue and cancellation of investment conformity. It dismissed the citizenship challenge and recorded that the conformity cancellation had not itself been challenged. The court also explained that the factual or legal obstacle supporting Article 40 must relate to conditions at or before acquisition, even if discovered later. This is a fact-specific investment case, not a ruling that every valuation discrepancy requires loss of citizenship. The judgment expressly allows an appeal to the Council of State Administrative Litigation Chambers Board within thirty days following notification. Whether an appeal was lodged and whether the judgment became final have not been independently established here. [S8]
News & Legal Developments
Indictment following citizenship-investment investigation
23 September 2025 investigation; 25 February 2026 prosecution report. Anadolu Agency reported that an indictment following the September 2025 investigation had been accepted by a criminal court. The reported allegations included sham property transactions, simulated payment movements and inflated property values used in citizenship applications. An accepted indictment begins criminal proceedings; it is not a final conviction or a determination that every investor in the affected transactions acted unlawfully.

Anadolu Agency reported a further investigation concerning allegedly fictitious property sales and inflated valuation reports. It also relayed an Interior Ministry statement describing investment conformity cancellations and separate citizenship cancellation or withdrawal decisions following administrative examinations. These are reported investigative and administrative findings, not proof that each decision has survived final judicial review. The legal basis and evidence must be checked in each individual file.

TKGM announced an amendment to Circular 2024/4. The amended valuation/TTB procedure and a decision cancelling an existing conformity certificate must be distinguished. The announcement alone does not establish the grounds or outcome of an individual citizenship case.

Identify all operative decisions and their notification dates. A Presidential citizenship decision engages the Council of State’s first-instance jurisdiction; a separate land-registry/conformity act requires its own jurisdiction and venue analysis. Do not assume that the same court or a single petition necessarily covers every act. [S4]
The general administrative litigation deadline is sixty days where no special period applies, normally calculated from the day following written notification. Service on an authorised representative and any earlier knowledge or administrative application require careful assessment. Requesting records should not be assumed to suspend the deadline. [S3]
Filing an ordinary administrative action does not automatically suspend the challenged act. A request for a stay of execution must address both manifest unlawfulness and harm that would be difficult or impossible to repair. A court order is not guaranteed. [S3]

What if the investor was unaware of third-party irregularities?
The investor’s knowledge, declarations and involvement should be assessed separately from allegations against a seller, intermediary or valuation provider. Preserve the instructions given, correspondence, payment records and documents received or signed. Article 31 concerns the person’s false declaration or concealment of material facts; an Article 40 withdrawal raises a different question about the original legal conditions. Good faith must be evaluated against the provision actually relied upon and the evidence. It does not, on its own, guarantee that citizenship will be retained or that a court challenge will succeed.
Family, residence and property consequences
Identify how each family member acquired citizenship and which persons the decision covers. Article 32’s dependent-acquisition rule must not be generalised to every relative or every legal basis for loss of status. Residence, identity-document and property consequences require coordinated review; do not assume that an ongoing citizenship case automatically grants a residence permit or suspends every related act.
The original investment documents should be preserved even after the holding period. A later lawful resale and an alleged original documentary defect raise different questions. Claims against a seller, agent or valuation provider may also require a separate assessment; they do not replace an administrative challenge.
Questions to address with counsel
Does cancellation of conformity itself cancel my passport?
Cancellation of an investment conformity certificate is not itself a citizenship cancellation decision. Identify the separate citizenship decision and any passport-related implementing measures; these are distinct administrative acts.
Is good faith enough to resolve the case?
No. Good faith alone does not resolve the case. It is an important factual issue, particularly where false statements or concealment are alleged, but it does not replace examination of the statutory basis and the original investment conditions.
Can a new valuation fix the problem?
Not automatically. Its relevance depends on the defect, applicable date, procedure and evidence. Preserve the original report and all revisions.
Should I challenge only the citizenship decision?
Not necessarily. The conformity decision may require a separate timely challenge. Have every operative act reviewed promptly so that a challenge to one decision does not leave another applicable deadline unaddressed.
Can citizenship be guaranteed to be restored?
No. Relief depends on the challenged acts, evidence and judicial assessment.

Obtaining an individual legal assessment
A person affected by a conformity cancellation or citizenship decision can seek an individual assessment of the decision, notification records, investment evidence and available remedies. The initial review should identify each challenged act, the applicable filing period and whether interim protection should be requested. To arrange an assessment, use the G&K Partners Contact page. Provide a brief description and the notification date; agree a secure method before sending identity documents or the full case file. General information on the investment framework is available in the Turkish Citizenship by Investment guide.
This guide provides general legal information. The applicable remedy and deadline depend on the decision, notification and individual circumstances.
