Rent Determination and Rent Adjustment Lawsuits in Türkiye: Legal Differences, Conditions and Mediation
Published:
Landlords and tenants in Türkiye may disagree over rent following changes in market conditions, inflation or unforeseen economic circumstances. Turkish law provides different mechanisms: a rent determination action under Articles 344–345 of the Turkish Code of Obligations is distinct from contractual adjustment based on excessive difficulty of performance under Article 138. Legal bases, evidence and effects differ.

1. Annual Rent Increases
For residential and roofed commercial premises, Article 344 governs agreed renewal increases and rent determination. Under the general rule, renewal increases cannot exceed the twelve-month average CPI (TÜFE) change, subject to the governing statutory framework. A landlord cannot automatically impose prevailing market rent at each renewal.
2. What Is a Rent Determination Lawsuit?
An action requesting judicial determination of rent for the relevant rental period. Approach depends on lease duration and legal circumstances. For tenancies exceeding five years, and relevant subsequent five-year intervals, Article 344 provides judicial determination considering property characteristics, comparable rents, CPI and equity. Advertised asking prices are not mechanically substituted for the agreed rent.
3. How Does the Five-Year Rule Work?
The five-year framework permits a broader examination of comparable rental values than ordinary annual increases. Relevant evidence includes comparable leases, location, area, condition, amenities, permitted use and effective rental periods. A landlord’s requested amount is not automatically accepted. An earlier contractual increase does not necessarily make determination proceedings unavailable.

4. When Does Determined Rent Take Effect?
Article 345 governs timing and whether a determination applies from the beginning of a new rental period. Timely written notice, an agreed rent-increase clause and filing dates may be significant. Where the lease provides for an increase, proceedings brought before the end of the new rental period may establish rent effective from its beginning. Otherwise, the statutory thirty-day advance filing or written-notice conditions and the subsequent filing date must be considered. Distinguish the amount of rent determined from the period in which it legally applies.
5. What Is a Rent Adjustment Lawsuit?
Article 138 governs excessive difficulty of performance (aşırı ifa güçlüğü) in exceptional circumstances. It is not automatically available whenever market rents rise. Review extraordinary unforeseeable events, risk allocation, severity of performance difficulty and the claimant’s position. Where contractual performance occurred, any legally required reservation is also relevant.
6. Rent Determination vs. Rent Adjustment
| Issue | Rent determination | Rent adjustment |
|---|---|---|
| Legal basis | TBK Articles 344–345 | TBK Article 138 |
| Central question | Appropriate rent under statutory framework | Exceptional circumstances justifying adaptation |
| Main evidence | Tenancy duration, CPI, comparables, equity | Contractual context, unforeseeability, risk, hardship |
| Automatic entitlement to market rent | No | No |
| Timing and effect | Subject to Article 345 and other rules | Depends on Article 138 and applicable proceedings |
7. Mandatory Mediation
Rent determination and adjustment litigation generally fall within Article 18/B of Law No. 6325. A claimant must account for pre-litigation mediation and applicable substantive and procedural periods. Mediation does not require a settlement; litigation may proceed after an unsuccessful procedure where legally available.

8. Documentation
A case assessment generally includes the lease and amendments, commencement and renewal dates, rent payment history, increase clauses, notices, comparable rental evidence and records of material changes. Whether the property is residential, roofed commercial or another type of premises matters.
Frequently Asked Questions
Can rent be raised to market value after one year? Not automatically; statutory renewal limits remain relevant.
Does every five-year tenancy justify the requested increase? No; the court assesses legal criteria and evidence.
Does inflation automatically justify adjustment? No; Article 138 imposes separate conditions.
Conclusion
Rent determination and adjustment serve different purposes. Correct claim classification determines the legal analysis, evidence and potential effective date.
